Fees
At Castaneda, Ming & Kojikian, there are a number of fee structures available to clients depending upon their needs and the type of legal issues involved. For most matters, our attorneys charge an hourly fee for their work, and the client is billed monthly for attorney fees incurred during that months. Invoices are due upon receipt unless otherwise agreed. The type of fee structure that applies to a particular matter will be reflected in writing, as part of an initial legal representation agreement, or as a supplement to an ongoing attorney-client representational contract.
Hourly, Fixed, Contingent
Hourly rates are usually charged in litigation matters. Sometimes, retainers may be requested and the hourly fees deducted from those retainers. Retainers may be required to be replenished periodically as well.
Fixed fees are available at the firm in some situations. Here, a set amount is charged at the beginning of the representation and this flat fee covers the entirety of the attorney’s work on the matter. Fixed fees are often available in basic transactional situations (e.g., drafting of employment agreements, filing a copyright, etc.). Fixed fees do not include costs (see below).
Contingent fees are sometimes offered in special circumstances. While contingent fee agreements are commonplace in personal injury litigation, they are not as conducive to business matters and accordingly are not as prevalent in commercial litigation cases. However, we understand how there may be occasions where a contingent fee arrangement may be the only way for a business to proceed in a valid commercial controversy. Accordingly, we may be amenable to a contingent fee arrangement in a specific, unique case.
Costs
Costs are all expenses associated with a matter that are outside the legal service provided by the attorney. In other words, “costs” are everything outside of the attorney’s actual fee. Costs can include filing fees, court reporter charges, postage, travel expenses, courier charges, expert witness fees, survey costs, appraisal fees, etc. Costs are billed to the client unless otherwise agreed upon in writing.
